Privacy policy

1. Controller

The controller for the processing of personal data in connection with this website is PHARMEQ AG, Birchweidstrasse 6, 8808 Pfäffikon SZ, Switzerland.

No data protection adviser within the meaning of art. 10 FADP has been appointed; for private controllers such an appointment is voluntary.

2. Scope

This policy applies to the website at pharmeq.ch. For third-party websites we link to, the privacy policy of the respective operator applies.

3. Legal basis

We process personal data under the Swiss Federal Act on Data Protection (FADP). Where individuals in the EU are affected, we additionally observe the General Data Protection Regulation (GDPR).

Processing is based on our legitimate interest in the secure and uninterrupted operation of the website and, where you contact us, on the initiation or performance of a contractual relationship. As we set no cookies for analytics or advertising, visiting the website requires no consent.

4. Data processed

  • Server log data: IP address, date and time of access, page requested, referring page and browser type. This data arises technically with every request.
  • Contact data: information you send us by email or telephone, in particular name, organisation, email address, telephone number and the content of your enquiry.
  • The enquiry form on this website transmits nothing to us: it opens your own email program with the details you entered. The enquiry leaves your device only once you send it yourself. No form input is stored on this website.

5. Purposes of processing

  • Secure and stable operation of the website, and detection and prevention of abusive access.
  • Answering and handling your enquiries, and initiating and performing contracts.
  • Compliance with legal obligations, in particular commercial and tax retention duties.

6. Cookies, tracking and external content

This website sets no cookies for analytics or advertising and embeds no audience-measurement services. No social media elements are embedded.

All fonts and images are served from our own domain. Visiting the website therefore establishes no connections to third-party servers and transmits no IP address to third parties.

7. Hosting

The website is hosted by Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany, in a data centre in Germany. The server log data referred to in section 4 arises in the process.

This is based on a data processing agreement with the provider which limits processing to our instructions (art. 9 FADP, art. 28 GDPR).

Germany and the European Economic Area offer a level of data protection recognised as adequate by the Swiss Federal Council; no additional safeguards are required for processing there.

This concerns technical server log data only. The content of your enquiries reaches us through your own email program and is not transmitted via this website.

8. Disclosure to third parties

Personal data is not sold and is not passed on for advertising purposes. It is disclosed only to service providers required to operate the website or to handle an enquiry, and to authorities where we are legally obliged to do so.

9. Retention

Server log data is processed automatically by the hosting provider and deleted after a short period; we carry out no permanent analysis of it.

Correspondence relating to enquiries is retained for as long as the matter is being handled and a business relationship exists. Where it concerns business transactions, it is subject to the ten-year retention obligation under art. 958f CO.

10. Your rights

You have the right to information about the personal data processed about you, and to its rectification, erasure or the restriction of processing. You may object to processing and request the release or transfer of your data (art. 25 et seq. FADP, art. 15 et seq. GDPR).

Please use the contact details given under section 1. To handle a request for information we must verify your identity.

You may also lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC), Feldeggweg 1, 3003 Bern. Individuals in the EU may contact the supervisory authority of their country of residence.

11. No automated individual decisions

We take no decisions based solely on automated processing that produce legal effects concerning you or significantly affect you. No profiling takes place.

12. Data security

The website is delivered exclusively over an encrypted connection (TLS). Further technical and organisational measures are described in our information security policy (PQ-COM-11).

13. Changes to this policy

We amend this policy when our processing or the legal position changes. The version published on this page bearing the status date above is the one that applies.
